Court Adopts Commission’s Proposed Rule to Limit Admissibility of One’s Immigration Status into Evidence

The Commission was pleased to learn that on August 11, 2021, the Supreme Court of Pennsylvania adopted Pennsylvania Rule of Evidence 413, which substantially limits the admissibility of one’s immigration status into evidence during litigation. The Rule was initially suggested to the Court by the Commission, and once it was formally proposed by the Supreme Court Committee on Rules of Evidence, the Commission submitted comments supporting the proposal with minor changes. The rule will take effect on October 1, 2021.
